TERMS OF SALES

ORDERS AND CANCELLATIONS

OUR CONTRACT

Any order and subscription request is subject to processing and acceptance by FLOWERADDICT. FLOWEDRADDICT (and all of its staff), reserves the right, at its sole discretion, to refuse any order, at any time and for any reason. In case of refusal, we will cancel the order or refund the full amount, using the payment method used during the initial order. The acceptance of the order and the conclusion of the contract only take place from the moment the request is processed.

DELIVERY DATES

All our deliveries are made within 2 to 3 working days. When it comes to floral subscriptions, you can choose the frequency of delivery and we will do our best to satisfy you, with no guarantees offered.

RIGHTS OF WITHDRAWAL

You can only benefit from the right of withdrawal if we have not started preparing the order. You can do this by getting in touch with after-sales service.

SUPSEND OR CANCEL YOUR SUBSCRIPTION

You can suspend or terminate your floral subscription at any time by giving notice of at least 48 hours before the date of your next delivery. If these provisions are respected, the suspension or termination will be effective without costs or penalties. If the payment has already been taken into account? we will issue a refund using the payment method used when ordering. If the cancellation deadlines are not met and we are unable to honor your request, you will still receive your order and be billed (as we will have already started preparing the order). Regarding the suspension of subscription, you can submit your request as many times as desired, unless you send us a request for termination.

RATES OF OUR SUBSCRIPTIONS

The price of each subscription is the price at the time the subscription is set up. We reserve the right in our sole discretion to increase these prices at any time to take into account changes in the conditions for determining prices, including among others, price increases from our suppliers and partners. If we change our prices, we will notify our subscribers at least 4 days before their next delivery, giving the option to cancel the subscription without costs or penalties. If we have no news from you within 48 hours of the date of your next delivery, the contract will be renewed under the new conditions.

PAYMENT METHODS

We accept payment by credit card but also by PayPal account transfers .

For all floral subscriptions, a global proforma invoice will be sent to you following your deliveries at the end of each period.

Following payment of the said proforma invoice, your final invoice will be sent to you.

LATE PAYMENT

Any order placed after FLOWERADDICT is subject to invoicing that will not be paid on the due date may be subject to an increase of 9% interest on its total value.

DELIVERY COSTS AND VAT

All delivery prices are inclusive of VAT (VAT at the rate in force).

DELIVERY

Deliveries are made using our own vehicles to the delivery address provided. We reserve the right to restrict deliveries to certain geographic areas and this includes the right to remove certain areas from our delivery schedule.

If the delivered goods do not conform due to incorrect or incomplete and / or damaged delivery, you must notify us within 24 hours. You will not be charged for any damaged merchandise or merchandise you have not received. In any event, our liability will be limited to the price of goods not delivered or incorrectly delivered and the cost of delivery. We take special care to ensure that deliveries are made on time. Therefore, in the event of absence, it is your responsibility to ensure that your representative is available at the delivery address at all times during the date and time of delivery. If no one is present at the place of delivery to receive the package? a delivery slip is left and your order is held at our premises until you provide us with further instructions. We will call you to try to reorganize the delivery at your expense. We reserve the right to invoice you for all the costs incurred by perishable products and the costs of delivery.

Note that deplorable weather conditions and any other case beyond our control may prevent the normal performance of the contract, and consequently lead to a delay or cancellation of delivery. We will contact you to reorganize a delivery.

Our liability will be limited to the price of the undelivered goods and the costs of delivery. In the event that you ask us to leave an unattended delivery to your address, we expressly disclaim all liability for loss or damage, product contamination and changes in weather.

POLITICAL BACK AND REFUNDS

We assure our customers the delivery of fresh flowers, done on time.

FRESHNESS AND DAMAGE

Our flowers are often delivered in buds, in order to preserve their freshness and thus extend their lifespan. Our flowers are carefully packaged to ensure they arrive as fresh and beautiful as when they left us. however, it is possible that, for reasons beyond our control, the flowers are damaged during transport. In this case, please contact our after-sales service.

If, at our discretion, the flowers do not appear to us to be up to the required height of FLOWERADDICT, we will offer you the choice of a replacement at the next possible date, or a refund. In order to process the refund, we ask that you email us a photo of the flowers that do not appear to be fresh or damaged within 24 hours of delivery. In the event of a refund, we will return the full amount paid for the order to you within 3 days. Please note that an additional 3-5 day bank delay may apply.

If you have ordered one of our accessories and you are not satisfied with the condition in which it was delivered to you, please contact customer service so that we can help you.

NOT DELIVERY

Although we make every effort to deliver our flowers on time, occasionally a logistical problem may prevent us from doing so. If we are unable to deliver to you (if your flowers are still not delivered 3 days after the expected delivery date), we will, at our discretion, deliver a replacement bouquet to you at the next possible date, or to proceed with the reimbursement. In the event of a refund, we will return the full amount paid for the order to you within 3 days. Please note that an additional 3-5 day bank delay may apply.

RETURNS

Due to the perishable nature of flowers, we cannot accept returns on these products. If you want to return one of our accessories, you can do so within 14 days of the date you placed your order. We will reimburse you for the price you paid for the product, together with the associated standard shipping costs, with the costs associated with returning the products for you.

AVAILABILITY OF FLOWERS AND SUBSTITUTION

All of our flowers and plants are subject to availability. In the event that products from our suppliers do not present optimum quality, we reserve the right to substitute each product with another of equivalent style and value. and a similar or greater amount. If, exceptionally, we are unable to provide you with a satisfactory replacement, we will issue a full refund for the order.

PROMOTIONAL CODES & CONDITIONS OF OUR OFFERS

From time to time, we may offer products at reduced prices. These promotional offers are valid from the date they are announced until the end of the offer. It is not possible to benefit from the offer before or after these dates.

In the event that a customer makes a purchase and the price of the purchased product is subsequently reduced or subject to a promotional offer, the price applied will be that indicated on the date of purchase. We are unable to apply a promotional offer on a product purchased before the start of the offer.

Since our special offers depend on their availability, we reserve the right to change the terms of promotional offers and promotional codes, or to withdraw them, at any time and without notice.

We also reserve the right, at our discretion, to provide personalized promotional offers that only the relevant customer can benefit from.

Unless otherwise stated, welcome promotional offers are exclusively reserved for new FLOWERADDICT customers, and valid only once per person.

CIRCUMSTANCES INDEPENDENT OF OUR WILL

BAD WEATHER CONDITIONS

In the event of inclement weather, we cannot be held responsible for any late delivery and may not be able to provide replacement delivery or a refund of affected orders.

MAJOR FORCE

FLOWERADDCIT cannot be held responsible for the delay or the failure to meet its obligations in the event of force majeure. There is force majeure when an event beyond our control, which could not be reasonably foreseen when ordering and whose effects could not be avoided by appropriate measures, prevent delivery. These include: (I) natural disasters, (II) start of hostilities, riot, civil disturbance, acts of terrorism, (III) the act of any government or authority (including refusal or revocation of any license or consent), (IV) fire, explosion, flood, fog or inclement weather, (V) power failure, failure of telecommunications lines, failure of plant, machinery or vehicles, ( VI) theft, damage caused by malicious intent, strike, industrial action of any kind and (VII) any cause or circumstance beyond the control of FLOWERADDICT.

If the impediment is temporary, the order is suspended unless the resulting delay does not justify the cancellation of the order. If the impediment is final, the order is canceled and we will not be able to provide replacement delivery or a refund of the affected orders.

OUR RESPONSIBILITY

We make all necessary and reasonable efforts to ensure that FLOWERADDICT services are fully operational and error-free.

 

However, we cannot be held responsible for any interruption of the FLOWERADDICT services and will be released from all our obligations if a reason beyond our will or our control does not allow us to provide the FLOWERADDICT services.

FLOWERADDICT declines absolutely all responsibility in the event of: (I) losses which were not caused by a fault on its part, (II) commercial losses (including loss of profit, profit, contracts, expected savings, data , customers or superfluous expenses), and (III) losses, indirect or consequential, which were not foreseeable when you started to use the FLOWERADDICT services.

We are not responsible for the delay or failure of a request for any reason beyond our control and not arising from willful failure on our part.

Our liability is incurred for death or personal injury resulting from our negligence or any acts resulting from fraudulent actions on our part.

PERSONAL INFORMATION OF CUSTOMERS AND RECIPIENTS

It is essential that the personal information we receive is specified. We use this information to manage orders, deliver products and services, enter payments, communicate with you about orders for products, services and promotional offers.

We are committed to protecting the personal data of customers communicated on our website.

The personal data communicated will be used for the purposes of using our services and will not be communicated to third parties without the prior authorization of the customer. We take the privacy of your data very seriously, so we will not rent or sell your private information.

CUSTOMER E-MAIL ADDRESS

We use this information to provide the best experience for our customers, sending order confirmations, replacement information, shipment confirmations, and delivery confirmations. We will also use the customer's email address for occasional marketing communications. Please ensure that the e-mail addresses are correct.

We use this information for delivery and invoicing.

CUSTOMER'S PHONE NUMBER

We use this information to contact customers, if there are issues with the order, such as payment failures or delivery issues.

NAME AND FULL ADDRESS OF RECIPIENT

We need this information to deliver the flowers you have ordered. It is essential that the recipient's address is correct.

GENERAL

We reserve the right to update, modify or replace all or part of these general conditions of sale, by posting updates and changes on our website. It is therefore your responsibility to check our general conditions of sale whenever requesting a FLOWERADDICT service. Any modification will be effective within 5 hours after publication in all subsequent transactions will take into account these new general conditions of sale.

In addition, we reserve the right to suspend, restrict or terminate access to the FLOWERADDICT website and / or FLOWERADDICT services, for any reason and at any time. We make every effort to limit the frequency and duration of these interventions and will inform you if there is suspension.

In the event of a contradiction with any notices, policies, disclaimer or conditions present on the FLOWERADDICT website, these general conditions of sale shall prevail. If one of the stipulations of these general conditions of sale is deemed invalid or inapplicable, the other provisions will remain in force.

These general conditions of sale replace all previous agreements (written or oral) between FLOWERADDICT and the customer and set out all the clauses of this agreement.

For any order made in Belgium and delivered in Belgium, the general conditions will be subject to Belgian law, and the Belgian courts will be competent.
